The claim under the wrongful death statute and the claim under the survival statute are separate and distinct with separate and distinct purposes even though they originate from same wrongful act. The wrongful death statute makes the person who caused the death accountable for the damages caused to those the decedent leaves behind; the survival statute makes the person who caused the death accountable for the damages caused to the decedent. The purpose of providing both causes of action is to give and preserve to the parties damaged a complete remedy and opportunity to recover for the complete loss sustained because of the wrongful injury and death.

Arizona statutes that deal specifically with claims allowing compensation for wrongful death identify who can bring the claim, who can recover compensation, and what damages are recoverable. This statutory claim may be brought by a surviving family member such as spouse, child, or parent of a decedent to compensate them for the losses they sustained as the result of the wrongful death of their family member. The “wrongful” act that resulted in a death may have been intentional, reckless or negligent, as long as it is of the character that would have permitted the decedent to maintain an action for injuries had death not resulted.

A wrongful death claim allows compensation for the injuries and losses that the surviving family has suffered due to the victim’s death, including the victim’s lost future earnings and benefits. Some of the factors involved in calculating these damages include how dependent the family member was on the deceased, what relationship the family member had with the deceased, the anticipated lifespan of the deceased, and the anticipated earnings or other benefits of the deceased.

Survival Claim

The purpose of the survival statute is to preserve the claims of the injured party after his or her death. The survival action functions to benefit the decedent’s estate with the intent of preventing the wrongdoer’s liability from ceasing upon the injured person’s death. The survival action permits recovery for the wrong to the injured person and is confined to his personal loss.
